E-design Terms of Agreement

E-design is an online designing consultation service only. All recommendations are regarded as suggestions to improve the look of your space and not intended for construction purposes. Any structural work or changes should be approved by and architect and/or a structural engineer or contractor.

Product sourcing is limited to Canada and/or USA. Pre-construction rooms unfortunately cannot be used.

Client agrees to provide full information regarding the client’s requirements for the project. The client is responsible to make sure all documents are sent out before starting the design process and can’t be changed during the working process. Bibby Fine Interiors will provide “Measurement Instructions” to guide you on how to properly measure a room. Photos of your room is required and a rough sketch of the lay-out. BFI cannot be held responsible for accurate measurements. It is the client’s responsibility to make sure that all measurements are correct and all design work will be based on these measurements. It is also the client’s responsibility to check all doorways, stairways and elevator sizes for delivery and make sure there is a clear delivery path. Furniture cannot be returned due to fit issues.

Design work will only start upon receipt of the Client Service Agreement, payment of fees, and Client Questionnaire.  If changes are made by the client after the design has begun, additional time and/or fees may be required and documented in writing

E-design product deliverables will be sent to the client within 14 business days (or another agreed upon timeline as stated in the Client Service Agreement) of the project start date.

Bibby Fine Interiors will perform services as expeditiously as is consistent with professional skill, care and the orderly progress of the E-design project. In the event that the client does not respond to questions and the revision in a timely manner (more than 7 days), the project will be put on pause and work on the project will only re-commence at a date and time that suites the schedule of Bibby Fine Interiors. In the event the client does not respond for 21 days, the project will be terminated at that stage and Bibby Fine Interiors will not continue any more work on the project, project fees are non-refundable.  

E-design client agrees to correspond strictly through online communication.

Bibby Fine Interiors will not be responsible for the means, methods or procedures of construction, fabrication, delivery & installation, or safety precautions in connection with the E-design project; will not be responsible for the acts or omissions any contractor or subcontractor, supplier or other person performing the work on the E-design project; or, for any failure of them to meet any schedules or completion dates.

Bibby Fine Interiors cannot be held responsible for arranging repairs, replacement or freight claims for purchases made in conjunction with recommendations for E-design project.

For custom made cabinetry, Bibby Fine Interiors will not be held responsible for any inaccurate dimensions that are given by the client. Any custom made cabinet such as kitchen or bathroom should be verified by the cabinet manufacture as to final dimensions.

Bibby Fine Interiors will be working with the client’s budget. On occasion, freight and delivery charges are not known until the end of the lead-time. Prices of furnishings and other products are subject to change. Bibby Fine Interiors will recommend products that are currently in stock, if your selected items are not available or in stock at a later date, Bibby Fine Interiors are not responsible for finding replacement items as part of this agreement. Bibby Fine Interiors will be available to resource new items under a new agreement and charged at our current hourly rate, as shown on our website.

E-design client agrees to provide photos of the e-design project after completion for marketing purpose. E-design client grants permission to Bibby Fine Interiors to use concepts, 3d renderings and textural materials which were used or created in association with the interior decorating, redesign or staging of my project, for social media and printed media publications, such as magazines and newspapers, without notifying me. In the event my home is selected for online or printed publications, I understand my address and identity will be kept confidential.

Bibby Fine Interiors has taken every measure to prevent internet fraud and ensure any data collected from the client is stored as securely and safely as possible. Furthermore, Bibby Fine Interiors cannot be held liable in the extremely unlikely event of a breach in secure computer servers.

Online E-design services are to be paid in full and are non-refundable. Bibby Fine Interiors provide services with all the skill, and care of a professional interior design company.

Your E-design package will include 2 concept boards which we will review together, this revision is included in the fee, any further revisions will be charged at our hourly rate as shown on our website.

Bibby Fine Interiors will make recommendations on furniture based on our knowledge and customer reviews of products, but cannot be held responsible for the final quality of any furniture or accessory that are suggested in the shopping list for the E-design service.

Because of the nature of E-design, it is recommended that the client request fabric and other samples from suppliers to double check color, texture and suitability for the project. It is the client’s responsibility to request and verify all samples and color coordinating before ordering from the shopping list. BFI can arrange samples of fabric and other materials and paint swatches as an additional service charged at our hourly rate as shown on our website.

Most E-design clients will buy their items from the supplied shopping list. If however the clients needs the services of BFI to order products and arrange delivery we do need 100% of the cost of the item including shipping charges before ordering items. When purchasing products for clients we apply a standard 20% procurement fee regardless of vendor and BFI shall not be required to reveal ‘to the trade’ pricing or commissions to the client. Invoicing will be direct from BFI and not the individual vendors. BFI Invoices will serve as proof of purchase for warranty purposes. Client shall have the benefit of all guarantees and warranties possessed by us against suppliers and manufacturers to the extent transferrable. We make no warranties for the goods or services we propose, design or provide over and above the manufacturer’s or supplier’s warranties. We cannot guarantee any fabric, material or article against fading, wearing or latent defects over and above the manufacturer’s warranty. Custom items, fabrics, window treatments, and wallcoverings cannot be cancelled or returned once ordered. If returns are allowed, the Client is responsible for restocking fees and charges. Should the original packaging not be available to return the merchandise, the Client will incur the cost to adequately ship the merchandise. All service associated with returns and cancellations will be billed hourly.

Any E-design work submitted to the client is the property of Bibby Fine Interiors and all copyrights and other proprietary rights applicable there to remain at all times Bibby Fine Interiors property.

I am 18 years of older and competent to contract in my own name. I have read the Terms of agreement before signing below and fully understand the content and meaning of the agreement. This agreement has 2 pages.
